Scope and key definitions

These conditions apply to all recruitment and executive search services provided by Precision Consult BV. Instructing us to start a search, requesting candidate profiles or paying an invoice means the conditions are accepted, with or without formal signature.

  • Candidate: any person whose profile, name, contact details or CV we share with the Client, anonymised or not, in writing or orally.
  • Engagement: any professional relationship between the Client and a Candidate, including employment, a freelance or consultancy agreement, a partnership, an interim mission or a collaboration through a management company.
  • Introduction: the moment we first share any personal information about a Candidate with the Client.
  • Affiliate: any entity controlling, controlled by or under common control with the Client.

Introduction of candidates

Direct introduction

Our fee becomes due when the Client, or one of its Affiliates, enters into an Engagement with a Candidate we introduced within twelve months of the Introduction. This period runs from the last contact between the Client and the Candidate.

Indirect introduction

If, within six months of the start date of a Candidate we introduced, the Client also engages members of that Candidate’s team, practice group or department, these hires are presumed to result from our introduction. The following fees then apply to fee earners:

  • 25% for the highest-paid hire
  • 23% for the second highest-paid hire
  • 21% for the third and fourth
  • 19% for all further hires

Fees

Our fee is a percentage of the Total Remuneration for the first full year of the Engagement. This includes the fixed gross salary (13 months in Luxembourg, 13.92 months in Belgium, 12 months for self-employed professionals), guaranteed bonuses, the value of a company car and fuel card (minimum €500 per month) and luncheon vouchers.

Total Remuneration, year 1 Fee
€120,000 or more 27%
€80,000 to €119,999 26%
€60,000 to €79,999 25%
Less than €60,000 24%

Guarantee period

The Client benefits from a twelve-week guarantee from the Candidate’s start date. It applies when the Engagement ends for reasons demonstrably linked to the Candidate’s technical or professional qualifications, and not in case of economic, restructuring or strategic decisions by the Client. A valid claim gives right to a credit pro rata to the full weeks remaining, limited to the fees already paid.

Liability

The Client remains responsible for its own selection and hiring decisions. Precision Consult cannot be held liable for acts or omissions of a Candidate in the performance of their duties. Clients are invited to assess and screen every Candidate before any hire, at their own cost.

Notification and disclosure

The Client informs Precision Consult in writing of any Engagement with an introduced Candidate within three weeks of signing or of the actual start.

Late notification entitles us to the full fee plus a 50% surcharge. If neither notification nor a copy of the contract is received within 30 days of the start date, liquidated damages of 1.5 times the applicable fee are due.

Invoicing and payment

We invoice once the Engagement is confirmed. The Client provides a copy of the contract or offer letter within five business days of signing, so the fee can be calculated accurately.

  • Invoices are payable within 14 days of the invoice date.
  • Late payment carries interest of 12% per year and a flat administrative fee of €250 (excl. VAT) per unpaid invoice.
  • All amounts are exclusive of VAT.

Data protection

Both parties act as independent data controllers under the GDPR. Candidate data is used to match people with suitable opportunities and is never shared with third parties without the Candidate’s prior consent. Personal data is kept for up to five years after the end of the relationship, unless the law requires otherwise.

Candidates and contacts can exercise their rights of access, rectification, erasure, restriction, portability and objection at any time via info@precision-consult.com.

Governing law and disputes

These conditions are governed by Belgian law. Parties first seek an amicable solution within 30 days. Failing that, a dispute can be referred to CEPANI arbitration in Brussels by mutual written agreement, or otherwise to the competent courts of Hasselt.

General provisions

If one provision proves invalid, the others remain in force. Amendments are only valid in writing and agreed by both parties. Not enforcing a provision never means waiving it.

This page is a summary for information purposes. The full General Terms and Conditions are shared with every assignment and prevail in case of any difference. You can request a copy at any time.
